WELLFLEET CONSERVATION COMMISSION
MINUTES OF MEETING OF NOVEMBER 5, 2003, 4:00 P., SENIOR CENTER

Present:  Cyndi Moe, Co-Chair; Edwin Reynolds, Co-Chair;
         Paul Banner, John DiBlasio, Dorothy Dolan, Abby                   Franklin, Virginia Page; Emily Beebe, Conservation                Agent; Birgitta Olson, Clerk.
Meeting called to order under the Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Ed Reynolds.

Business Meeting.
- New Commissioner Abby Franklin was welcomed.
- The Minutes of 10/15/03 were approved as amended, as MOVED by
 Dolan, SECONDED by Page, and CARRIED 6-0.
- A letter from Gordon Peabody was reviewed. This concerned a way
 to minimize damage to the environment from the discharge of
 concrete slurry. The consensus was that this should be adopted
  into the Commission's standard conditions. It should also be
 made known to DPW Director Mark Vincent when he comes on 11/19.
- A letter to the Division of Marine Fisheries drafted by Erik
 Mitchell thanking them for technical assistance provided for the   Herring River project was endorsed, as MOVED by Dolan, SECONDED
 by Moe, and CARRIED 7-0.
- Note was taken of the Selectmen's meeting on Goals & Objectives
 for the Town, to be held on Saturday 11/15. It was agreed that
 the Commission's long-term goals should be cited at that          meeting, for example, implementation of Regulations, management
 plans for use of Town-owned land, increased public education
 programs. It was agreed to have a meeting on 11/12 at 4 p.m. to
 write up a statement to be read at the 11/15/meeting.

Conservation Agent's Report.
Jurisdictional Opinions:
- Tree cutting by the Seashore
  at the Atwood-Higgins House, Bound Brook Island Rd. was           approved, as MOVED by Reynolds, SECONDED by Moe, & CARRIED 7-0.
- Installation of a test well for Baumgarten at 180 Herring River   Rd. was approved, as MOVED by Moe, SECONDED by Reynolds, and
 CARRIED 7-0. An RDA will be filed if the site is good.
- Replacement of a well for Scanlon, 55 Mill Hill Rd. was           approved, as MOVED by Banner,SECONDED by DiBlasio,&CARRIED 7-0.

- Ginie Page reported the cutting of Phragmites off Kendrick        Avenue   to create paths.
- She also noted that there is serious erosion on the bank at the
 old fire station on East Commercial Street.
- Cyndi Moe said Alison Palmer is asking when revegetation will     start on the Green property. Emily Beebe noted that the Robbins   Order of Conditions is valid for three years. It was agreed that   Emily should contact Mr. Robbins and find out what his            intentions are.
- Jan Plaue is asking when fencing will be installed around the
 High Toss stump dump to protect the abutting wetland. Emily said
 she is looking into using a cable instead of fencing.

- There was discussion of the pedestrian path promised off Cole's
 Neck Road. This will be brought up with Mark Vincent on 11/19.
- Regarding establishment of a location where shellfish gear can    be stored over the winter, it was agreed to wait until the new    Shellfish Constable has settled in.    


5:00. Public Hearing, submission of written comment on proposed revisions to Regulations supporting Environmental Protection Bylaw.(Continued from 10/15/03.) The Chair read the minutes of the 10/15/03 meeting. Cyndi Moe distributed an E-Mail submission from Jim O'Connell. Since the others had not read it, it was agreed to continue the hearing to 11/19/03.) MOVED by Banner, SECONDED by DiBlasio, and CARRIED 7-0.     


5:10. Town of Wellfleet & Cape Cod National Seashore, NOI: The Gut, off Chequessett Neck Road: Coastal Dune, beach & barrier beach protection & enhancement project.  Continued from 10/15/03.)
The Chair read the Minutes of 10/15/03. Emily Beebe described
what is proposed for walkways and fencing. Attorney Benjamin Zehnder, representing Lynch, said they have no issues with the plan as proposed, but his client is concerned about potential increase in traffic and ensuing problems with parking and turning vehicles around. It was agreed that this is not a Conservation Commission issue. Emily Beebe will take it up with the DPW Director. Mr. Zehnder asked for fencing at the top of the dune to prevent people from jumping down to the beach, and signage to guide people back from the beach. Conditions were set for the project. Since a DEP File Number has still not been received, the hearing was continued to 11/19/03, as MOVED by Moe, SECONDED by Reynolds, & CARRIED 7-0.


5:20. Town of Wellfleet, Wellfleet Herring Warden & Cape Cod National Seashore, NOI: Maintenance & improvement of Herring River herring run. (Continued from 10/15/03.)  The Chair read the Minutes of 10/15/03. Conditions were set for the project. Since a DEP File Number has still not been received, the hearing was continued to 11/19/03, as MOVED by Reynolds, SECONDED by Moe, and CARRIED 7-0.


Business.
- Draft texts of (1) Rules & Regulations for land under the care    of the Conservation Commission, and (2) Rules for hiring          consultants were distributed for review. It was agreed to have
 discussion on these at the 12/3/03 meeting.
- Emily Beebe will present a draft of a revised Fee Schedule at     the 12/3/03 meeting.

5:35. Paul & Janice Long, NOI 57 Wigwam Street, Map 35. Lot 158:
Addition. (Continued from 10/15/03.) The Chair read the Minutes of 10/15/03. Gordon submitted a mitigation plan for the removal of concrete, and conditions for limiting the existing garden from expansion and for supplementation with indigenous vegetation.
Cyndi Moe MOVED "that the Conservation Commission approve Felco Plan #03101, dated 8/13/03, subject to conditions specified."  SECONDED by Ginie Page and CARRIED 7-0. Conditions were set.
Supervisor: Abby Franklin.


Other Business.
- There was discussion on progress with bank stabilization on the   Pechonis property, 135 Old Truro Road with Gordon Peabody and
 Steve Pechonis. Mr. Peabody said there is good revegetation
 almost a year earlier than anticipated. Some invasive species,
 for example bamboo, will have to be cleared out. And some
 further stabilization at the foot of the bank will be provided.
- There was discussion with David Lajoie and Eric Winslow of the
 Downs project, Sandpiper Hill Road, where moving the septic tank
 and pump chamber to the south side of the driveway is now
 proposed to make room for a garage. It was the consensus of       Commissioners that the change in plan requires an amendment of
 the original Order of Conditions.  MOVED by Moe, SECONDED by
 Page, and CARRIED 7-0.
